Restructuring and Bankruptcy Litigation

We have extensive experience in restructuring matters, including cases under chapter 11 of the Bankruptcy Code, as well as in out-of-court workouts.

This work includes the representation of special servicers of securitized commercial mortgages, secured and unsecured lenders, individual creditors, landlords and investors in distressed assets and directors and officers of distressed entities, including those involving hotels and other hospitality assets, shopping centers and malls, office buildings, professional partnerships, a range of retailers, as well as single asset real estate and real estate investment trusts. 

We also represent parties to bankruptcy and creditors’ rights litigation, including core bankruptcy matters, related adversary proceedings, and other litigation.  Our matters include litigation of key bankruptcy issues such as use of cash collateral, automatic stay relief, plan exclusivity and chapter 11 plan confirmation. In addition, we represent parties to adversary proceedings involving preference and fraudulent transfer claims, as well as secured lenders in foreclosure and other enforcement actions and in lender liability matters, and represent monoline insurers in residential mortgage backed securities litigation.
